Delhi court rejects bail plea of former Maha minister Anil Deshmukh's lawyer

NEW DELHI: A Delhi Court today denied bail to former Maharashtra home minister Anil Deshmukh's Nagpur based lawyer, Anand Daga and a Central Bureau of Investigation (CBI) sub-inspector Abhishek Tiwari in a corruption case in which Daga is accused of allegedly trying to subvert the Bombay High Court-directed preliminary enquiry against Deshmukh.

After going through the application special CBI Judge Vimal Kumar Yadav said, it was evident that the investigation was still inconclusive and recoveries made during the investigation connected the accused with the alleged offence. 

Daga who is currently in judicial custody had moved the bail application, claiming that no purpose will be served by keeping him in custody since he was not required for further custodial interrogation.

Dismissing the application moved by CBI seeking for further police remand, Daga along with Tiwari were sent to 14 days judicial custody earlier this week.

While rejecting his bail plea the court noted that the accused was 'facing allegations of serious nature' and himself being a lawyer and was well-acquainted with the legal process and that it could not be ruled out that he may try to scuttle or influence the investigation which was not confined to a particular geographical area.

A report of the preliminary enquiry purportedly giving clean chit to Deshmukh was leaked earlier, which was widely circulated on social media, causing embarrassment to the agency.

Acting swiftly the agency detained Tiwari and Daga, along with Deshmukh's son-in-law Gaurav Chaturvedi for inquiring into the leak of the report. Subsequently, Chaturvedi was allowed to go, however, Daga and Tiwari were arrested on September 2 and taken to Delhi on a transit remand.

The agency has allegedly unearthed that Tiwari was given illegal gratification by the Daga and other accused in exchange for the internal documents of CBI.

The CBI had initiated a preliminary investigation on allegations of corruption against Deshmukh on the orders of the Bombay High Court in April 2021.
